By accessing elev8edtable.com or purchasing or using any of our products or services (collectively, the "Services"), you agree to these Terms of Service and to our Privacy Policy, which is incorporated by reference. If you are agreeing on behalf of a business, you represent that you are authorized to bind it. If you do not agree, do not use the Services.
Elev8ed Table LLC operates, under one Delaware entity: a restaurant directory and editorial publication; the Elev8ed Insights report product (Part B); ET Concierge (ETC) catering and private-dining inquiry capture and estimates (Part C); ET Concierge terms for participating restaurants (Part D2); Restaurant Listings (Part D); and The Elev8ed Brief newsletter.
Our editorial directory, guides, rankings, verification, and conclusions are determined by editorial merit only and are not for sale. No payment, purchase, subscription, listing, advertising, sponsorship, or partnership arrangement buys, changes, or influences whether a restaurant is covered, what is said about it, where it ranks, or whether it is verified. Any paid or sponsored placement, if offered, is clearly labeled and kept separate from editorial content. See our public Editorial Independence & Disclosure Statement. Nothing in any commercial agreement overrides this section.
You agree not to: (a) use the Services unlawfully or in violation of these Terms; (b) scrape, crawl, harvest, or bulk-extract content or data except as expressly permitted in writing; (c) resell, redistribute, or create derivative databases from our content except under a written license; (d) interfere with or disrupt the Services or circumvent security or access controls; (e) misrepresent your identity or affiliation; or (f) upload unlawful, infringing, or malicious material. We may suspend or terminate access for violations.
The Services, including our content, editorial work, methodologies, templates, schema, software, and databases, are owned by Elev8ed Table LLC or its licensors and are protected by intellectual-property law. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your own business purposes, subject to these Terms. All rights not expressly granted are reserved.
If you submit information (inquiry details, intake content, reviews, testimonials, or a factual correction), you represent that you have the right to submit it and that it is accurate. You grant us a license to use submissions to operate and improve the Services, subject to the Privacy Policy and, for testimonials, to the consent process described in our FTC Disclosure Policy. Restaurant client data grants are governed by Part D.
The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any outcome — including any search ranking, AI citation, traffic, or revenue result. Allergen/dietary information is informational only; we do not guarantee any restaurant is safe for any allergy or dietary need — confirm directly with the restaurant.
Your use of the Services is governed by our Privacy Policy, which describes what we collect, how we share it, your CCPA/CPRA rights, and our data-licensing and business-transfer practices.
If you provide your mobile phone number and opt in — for example, by checking the consent box in the chat widget on our website — you agree that we may send you text messages related to your requests and account, such as order confirmations, report-status updates, delivery notifications, and other service messages, and, only where you separately consent, marketing messages. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. Consent to receive text messages is not a condition of purchasing any product or service. Message delivery depends on your mobile carrier, and carriers are not liable for delayed or undelivered messages. How we handle mobile opt-in data is described in our Privacy Policy; we do not share mobile opt-in information with third parties or affiliates for their marketing or promotional purposes. We use Twilio, Inc. to send and receive these messages; see Twilio's privacy policy.
Elevated Insights is retired and is no longer offered, sold, or referenced as a current product. This Part B is preserved for historical record only. Elev8ed Table now offers ET Concierge (see Part C), a catering inquiry-capture and estimate service for restaurants.
NOTE (2026-09-07): the per-lead ET Concierge pricing referenced in this Part C is superseded by the Elev8ed Table Catering Growth System pricing ($199/mo standard, $99/mo founding, no per-lead fee) and is pending attorney review before republication. Preserved below for reference only. ET Concierge lets you submit a catering or private-dining inquiry to a specific restaurant and receive an instant estimate. You choose the restaurant — either by using ET Concierge on that restaurant's own website, or on the catering page we host for that restaurant. We deliver your inquiry to that restaurant and to no one else. ET Concierge is an inquiry and estimate service. It is not a booking, a contract, a quote, or a guarantee of availability, price, or service by any restaurant.
Submitting an inquiry creates no obligation on us or on any restaurant to respond, quote, or provide service. Any resulting engagement, contract, payment, and performance is solely between you and the restaurant. We are not a party to, and are not responsible for, that engagement, including food safety, allergen accuracy, service quality, cancellation, or payment. We deliver your inquiry only to the restaurant you inquired about; we do not send it to that restaurant's competitors and we do not add you to a general marketing list. Restaurants pay us for the service that delivers your inquiry to them. That payment does not influence which restaurant receives your inquiry, because you choose the restaurant — we do not choose it for you.
Details you submit (event type, date, headcount, budget range, dietary and catering notes, and contact information) are collected by Elev8ed Table and processed under the Privacy Policy, shared with the restaurant you inquired about so it can respond to you, and may be used in de-identified and aggregate form as buyer-intent data in our research, publications, and data products. Please do not submit medical information; dietary notes should describe catering requirements for your event, not any individual's personal health data. Your inquiry is delivered only to the restaurant you chose; we do not sell, license, or share your inquiry or your contact information with any other restaurant, caterer, or competing business.
By submitting an inquiry you agree we may contact you about it by email, phone, or SMS. Marketing messages are separate and require the consent described in our Email/SMS Compliance Policy; you can opt out at any time.
Where ET Concierge shows you an estimate, that estimate is generated automatically from catering pricing the restaurant has provided and confirmed to us. It is an estimate to help you plan — it is not a quote, an offer, a booking, or a guarantee of price or availability. The restaurant confirms all final pricing, delivery, taxes, and fees directly with you. Prices change; where we have it, we show the date the restaurant last confirmed its pricing.
Dietary information shown through ET Concierge describes what a restaurant reports it can accommodate. It is not a guarantee, and it is not a statement that any dish is free from any allergen or prepared in an allergen-free facility. Confirm every allergy requirement directly with the restaurant before ordering. Please do not submit medical information or any individual's health details in a free-text field.
The full, signable terms for paying restaurant clients are in our Restaurant Client / Listing Agreement, which controls for paying clients and is incorporated by reference. A summary follows.
NOTE (2026-09-07): the per-lead pricing terms referenced in this Part D are superseded by the Elev8ed Table Catering Growth System pricing ($199/mo standard, $99/mo founding, no per-lead fee, no setup fee) and are pending attorney review before republication. Preserved below for reference only. ET Concierge is software Elev8ed Table provides to participating restaurants to capture catering and event inquiries, produce estimates from pricing the restaurant has provided and confirmed, and deliver those inquiries to the restaurant. It is delivered either as an embed the restaurant installs on its own website, or as a catering page Elev8ed Table hosts for the restaurant and that the restaurant links to from its site. Elev8ed Table does not manage, access, or operate a partner's website, Google Business Profile, social accounts, advertising accounts, or point-of-sale system, and provides no done-for-you marketing, search-optimization, or website services under this Part. Nothing in these Terms grants Elev8ed Table access to any partner account.
There is no subscription and no setup fee. Founding partners receive qualified leads at no charge during their founding period. After that period, Elev8ed Table may charge $49 per qualified lead, and will give at least 30 days' prior written notice before any fee takes effect. No partner is charged for leads delivered during the founding period, including retroactively. A qualified lead is an inquiry with a telephone number verified by one-time passcode, complete contact details, an event date, a guest count, and an event location, that meets the partner's stated minimum guest count and service area, and that is not a duplicate within 30 days, spam, a test submission, a solicitation, a job application, or a vendor pitch. Anything failing those criteria is never charged, and a billed lead later found not to qualify is credited. Elev8ed Table takes no commission, percentage, or success fee on catering revenue, and is never the merchant of record for a customer's payment.
The partner supplies its own catering pricing and confirms that it is accurate. Elev8ed Table does not set partner prices; it may propose a draft assembled from the partner's published materials, but no draft becomes active until the partner has confirmed it. The partner keeps its pricing and menu current and re-confirms at least annually. Estimates are generated from what the partner supplied and are presented to customers as estimates, not quotes; the partner sets and confirms all final pricing, taxes, delivery charges, and fees directly with the customer. Dietary information describes what the partner reports it can accommodate, and is never a guarantee that a dish is free of any allergen or prepared in an allergen-free facility. The partner is solely responsible for food safety, allergen accuracy, and the accuracy of its menu and pricing. Elev8ed Table does not request and does not require a partner's cost, margin, profit-and-loss, or point-of-sale data in order to provide ET Concierge.
A partner may use a lead's information to respond to that inquiry and to fulfill the resulting event. Using it for general marketing beyond that inquiry requires the partner to obtain its own consent and to comply with applicable law, and is the partner's sole responsibility. The partner grants Elev8ed Table a worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to collect, process, aggregate, de-identify, analyze, publish, and license inquiry, estimate, response, and outcome data generated through ET Concierge, in aggregated and de-identified form, including for research, publication, benchmarking, and data licensing. That license survives termination of these Terms and any change of control of either party. Elev8ed Table does not publish or license data that identifies an individual customer, and does not attribute a partner's specific prices to it by name without the partner's consent. A partner may not sell, rent, license, trade, or otherwise transfer an inquiry or an inquiring customer's contact information to any third party. Elev8ed Table, for its part, never sells, licenses, or discloses a partner's inquiries or the identifying contact information of inquiring customers to any other restaurant or competing business; identifiable inquiries are disclosed only to the partner the customer chose to inquire about. This does not limit Elev8ed Table's use of aggregated, de-identified platform data described above.
Participation in ET Concierge, and any fee paid under this Part, purchases software and service on the partner's own website or hosted catering page only. It buys no editorial coverage, no directory placement, no ranking, no verification status, and no favorable treatment of any kind. Participating and non-participating restaurants are treated identically everywhere Elev8ed Table publishes, and the choice of which restaurant receives an inquiry is made by the customer, not by Elev8ed Table. A partner may request correction of a factual error, not approval or control of editorial conclusions. Section A3 governs and nothing in this Part overrides it.
Participation is month to month. Either party may end it on 30 days' written notice; on termination the partner removes ET Concierge from its website, and the license in Section D4 survives. Elev8ed Table makes no guarantee of lead volume, inquiry quality, bookings, revenue, search ranking, or citation or recommendation by any AI platform; results depend on the partner's own demand, pricing, and responsiveness. Elev8ed Table may later offer optional managed services, which could include managing a partner's Google Business Profile or accessing point-of-sale, analytics, or search-console data. No such service is offered today, no such access is granted by these Terms, and any such service will require separate written authorization from the partner before it begins.
If a dispute arises, please contact us first at [email protected] — most issues can be resolved directly. Any dispute arising from these Terms or the Services that cannot be resolved informally will be resolved in the courts described in Section E2. Nothing in these Terms limits either party's right to bring an individual action in small claims court.
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except that nothing in these Terms limits any non-waivable right you have as a California consumer under California law (including the CLRA, the Automatic Renewal Law, and the CCPA/CPRA). Any action will be brought in a court of competent jurisdiction.
To the fullest extent permitted by law, Elev8ed Table's total liability arising from or related to the Services is limited: for Elev8ed Insights, to the amount you paid for the report at issue; for the Restaurant Listing subscription, to the fees you paid in the 12 months preceding the claim; and for ET Concierge and free content, to $100. We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or lost business, arising from your use of or reliance on the Services.
You agree to indemnify and hold harmless Elev8ed Table LLC and its members, officers, and contractors from claims, damages, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Services, your submissions, or — for restaurant clients — your provision of data you were not authorized to provide.
We may update these Terms from time to time. Material changes will be reflected by an updated effective date and, where required, additional notice. For the auto-renewing subscription (Part D), material changes to price or renewal terms will be noticed as required by law before they take effect.
If any provision is unenforceable, the rest remain in effect. These Terms, the Privacy Policy, and any product-specific agreement are the entire agreement for the applicable Service. You may not assign these Terms without our consent; we may assign them, including in a business transfer.
